Terms of Service

1. Agreement and Provider

By creating an account, purchasing a plan, or using ProxyAPI (the “Service”), you accept these Terms. The Service is provided by Hugo & Friends AB, company reg. no. 559555-9989. A separate written agreement between the parties takes precedence over these standard terms in case of conflict.

2. Service

ProxyAPI provides an authenticated gateway for HTTP CONNECT/HTTPS plus smart routing, API keys, usage metering, a dashboard, health validators, a control API, and related tools. Exit IP, country, proxy type, provider, latency, and availability may change over time.

3. Account and API Keys

• Provide accurate information and keep contact and billing details current.
• You are responsible for all activity under your account and keys.
• Keys must be kept secret, stored securely, and revoked immediately if exposure is suspected.
• You may not create multiple accounts to bypass quotas, payment, KYC, or security controls.

4. Acceptable and Prohibited Use

You are responsible for having a legal basis, permission, and authority for your traffic, data collection, and processing. You must comply with law, court and authority orders, intellectual-property rights, and applicable target-site rules.

• No unauthorised access, intrusion, vulnerability scanning, credential attacks, or bypass of login, paywall, CAPTCHA, robots policy, rate limit, or technical access control.
• No DDoS, spam, phishing, fraud, malware, botnets, harassment, or unlawful surveillance.
• No collection, sale, or processing of personal data without a legal basis and required information to data subjects.
• No traffic that compromises ProxyAPI, upstream providers, exits, targets, or other customers.

5. Targets and Third Parties

ProxyAPI provides network access but no rights to third-party content or systems. You are responsible for target-site terms and collected results. We may block destinations, ports, protocols, or usage patterns for security, abuse prevention, upstream requirements, or legal requirements.

6. Plans, Usage, and Payment

Current prices, included traffic, key limits, and overage are stated on the pricing page or a separate order. Prices exclude VAT unless stated otherwise. Paid plans renew until cancelled. Stripe handles card payments; invoicing may be offered separately. Overdue payment may result in restriction or suspension.

7. Quotas, Availability, and Changes

We may apply quotas, rate limits, concurrency limits, and reasonable overload protections. A Business SLA applies only where expressly included in a plan or separate agreement. Other plans have no specific uptime guarantee. We may change or replace upstream providers and technical components without materially reducing the contracted core functionality.

8. Security, Monitoring, and Suspension

We process connection metadata and may use automated and manual controls for security, capacity, billing, and abuse investigations. We may immediately restrict or suspend traffic that presents risk, suspected abuse, breach, non-payment, or a legal requirement. Where possible, we inform the customer and allow remediation.

9. Personal Data

Our Privacy Policy describes our own processing. Where we process personal data on your behalf, our standard DPA applies unless a separate DPA is in place. Current providers are listed on the subprocessor page.

10. Intellectual Property

ProxyAPI code, brand, design, documentation, and compilations belong to Hugo & Friends AB or its licensors. You retain rights to your code and results. Feedback may be used to improve the service without disclosing confidential information.

11. Liability

The Service and exits are provided subject to the limitations of the internet and third-party networks. To the extent permitted by law, we are not liable for indirect loss, lost profit, lost data, or claims caused by customer use or a target site. Our aggregate liability is limited to the amount paid for the Service during the twelve months preceding the claim, unless otherwise agreed in writing. This does not limit liability that cannot be limited under mandatory law.

12. Termination, Changes, and Disputes

You may cancel using dashboard functionality or by contacting hello@proxyapi.se. We may update these Terms and will communicate material changes via the website, dashboard, or email. Swedish law applies and disputes are resolved by Swedish courts unless otherwise agreed.
